Trip and Fall on Sidewalk – Ankle, Knee and Neck Injuries – $1,500,000

Category: Premises Liability,

Plaintiff, a 32-year-old bank manager, was walking on the sidewalk in front of her apartment building when she tripped and fell over a raised flagstone. Plaintiff went to the hospital the next day complaining of ankle and knee injuries. Plaintiff sued the building owner for negligence in failing to maintain the sidewalk in a reasonably safe condition. Plaintiff uncovered evidence of prior complaints about the dangerous sidewalk to show that the owner knew of the condition. Plaintiff suffered tears in the ligaments in her ankle and knee, both of which required surgery. Plaintiff claimed she was needing future medical care including surgery. The case was resolved at mediation by HKD partner, Jordan Hecht.
