Plaintiff, 60 years of age on the date of the accident, was walking along the sidewalk and traversed over metal cellar doors in the sidewalk when the metal cellar door collapsed under the plaintiff’s weight. As a result, the plaintiff fell approximately 15 feet to the basement below, sustaining injuries to his neck, back, and wrist. Defendant claimed a lack of notice of any defective condition related to the metal cellar doors.
Following a course of conservative care and pain management, the plaintiff eventually underwent spine surgery to his cervical and lumbar spine, as well as arthroscopic surgery to his wrist. Defendant claimed plaintiff’s injuries were degenerative in nature and unrelated to the motor vehicle collision.
Judd F. Kleeger settled this matter while it was pending on the trial calendar for $5,750,000.
