Plaintiff, bicyclist, was struck by the passenger side mirror of a box truck as the truck passed the bicyclist. As a result of the impact, the bicyclist was caused to fall down to the ground and injure his back. Plaintiff sustained a fractured vertebrae to his lumbar spine and underwent rehabilitation therapy and treatment.
Defendants claimed the bicyclist changed lanes and turned into the truck’s lane and mirror causing the accident. An independent witness was identified at the scene that stated the bicyclist changed lanes and turned into the truck.
