Plaintiff, a Union Plumber with Local 1, was injured during the construction of the Frank Sinatra High School for the Arts. Plaintiff was walking when he was caused to trip and fall over loose construction debris. Plaintiff was diagnosed with a torn medial meniscus that required arthroscopic surgery. After several months plaintiff’s knee pain returned resulting in a second arthroscopic surgery and ultimately a total knee replacement.

The case was tried by Hecht Kleeger & Damashek, P.C., partner, Jordan Hecht, who established that the owner and general contractor did not have a sufficient number of laborers to keep the site clean and thus violated construction safety codes. The jury returned a verdict finding the defendants 100% responsible for the accident. The case settled for $2,125,000.00 just prior to opening statements on damages.
