Details of Dr. Hajhosseini’s Case

Babak Hajhosseini, a 42-year-old doctor associated with the Wound and Burn Centers of America, was recently arrested and charged with multiple counts of drug-induced rape and rape of an unconscious person. Once the victim arrived at his residence, he pressured her to consume an alcoholic beverage that rendered her unconscious. The LAPD believes that Hajhosseini then sexually assaulted and recorded her.

Hajhosseinin has completed fellowships and surgical training at Stony Brook Medicine, Nassau University Medical Center, and the Long Island Plastic Surgical Group.

What is Medical Professional Sexual Assault?

Any sexual advances or inappropriate behavior from healthcare providers are inherently exploitative due to the power imbalance in the professional-patient relationship. Even if a patient appears to consent, true consent is compromised when one party significantly influences the other’s well-being.

Types of Sexual Abuse by Healthcare Professionals

Sexual abuse can manifest in various forms, including:

  • Invasive Exams: Conducting unnecessary medical examinations.
  • Inappropriate Touching: Engaging in unwanted physical contact.
  • Sexually Suggestive Behavior: Making inappropriate advances during professional interactions.
  • Exploitation of Vulnerability: Initiating a sexual relationship with a patient in distress.

Recognizing sexual abuse in healthcare settings—through unnecessary exams, unwanted touching, or inappropriate comments—is crucial for seeking justice, as is addressing emotional and psychological abuse, including exploitation of vulnerability and grooming tactics.

If you or someone you know has experienced such abuse, understanding your rights and legal options is essential. At HKD Law, we advocate for survivors, ensuring your voice is heard and your case is taken seriously.

What to Do if A Doctor or Medical Professional Sexually Abuses You

Experiencing sexual abuse by a doctor or medical professional in NYC or LA is an incredibly traumatic event that can leave you feeling vulnerable and uncertain. Knowing how to respond is crucial to ensure your safety, preserve evidence, and access your support.

  • Ensure Your Safety: Move to a safe location and seek help from trusted individuals.
  • Document the Abuse: Write down details about the incident, including dates and locations.
  • Preserve Evidence: Avoid washing or altering any physical evidence and take photos of injuries.

  • Consult a Lawyer: An experienced attorney can guide you through the legal process and help you understand your rights.

How to Report Sexual Abuse by a Medical Professional

Experiencing sexual abuse by a medical professional, such as doctor, nurse, or therapist, can be devastating. Reporting the abuse is a critical step in seeking justice and protecting others. If you’re in New York or Los Angeles, follow these steps to navigate the reporting process:

Report to Medical Licensing Boards

If a doctor or physician is involved, file a complaint with the appropriate state medical licensing board. For example:

Contact Nursing Boards

If the abuse was perpetrated by a nurse, report the incident to the relevant nursing board:

Report to Professional Licensing Boards for Therapists and Counselors

If a therapist or counselor is responsible, notify the licensing authority:

File a Report with Law Enforcement

Reporting the abuse to law enforcement is vital, especially if it involves criminal behavior. Contact your local police department in New York or Los Angeles to file a formal report.

Taking these steps can help initiate an investigation and prevent further harm. If you’re unsure where to start, consider consulting an attorney experienced in handling cases of professional misconduct.
