Wrongful Discrimination in an Arrest

One of the most commonly practiced forms of racial profiling is that which has been found in practice among some law enforcement officers throughout New York City in the arrests that they make for traffic violations.

More specifically, this refers to officers who target certain sets of races when making traffic stops based upon their belief that one type of race is more prone to violating a traffic regulation than another.

Racial profiling, however, is not only a problem symptomatic among law enforcement officers who make traffic arrests. Discrimination based upon race, ethnicity, national origin and even religion can occur in many different situations, including arrests for both small and large criminal offenses alike.

Whether it’s realized or not, there can be no denying the fact that some officers and government officials tend to treat certain classes of race differently than others.

Racial Profiling Lawyer in New York City Our New York City Civil Rights Attorneys Can Seek Justice for You

As long time New York City personal injury attorneys working in the field, we acknowledge the fact that many law enforcement officers and government officials perform the duties of their jobs in an upstanding manner. We also recognize, however, that this is not always the case.

On more than one occasion, we have learned about a “criminal suspect” whose only real offense seemed to be their race, which we know is not actually an offense at all. As such, the suspect can be considered the victim of racial profiling, and accordingly, civil rights litigation might be necessary.

In 2003, the United States Department of Justice took matters into their own hands, instituting a provision in its guidelines for the prohibition of racial profiling. Unfortunately, more than a decade after the provision’s passage, the problem of racial profiling continues to exist, and it’s difficult to say if it will ever completely come to an end.

Accordingly, the law offices of Hecht Kleeger & Damashek, P.C., is prepared to advocate on behalf of anyone who has experienced prejudice or discrimination at the hands of a law enforcement officer in New York.
