A client was employed as a carpenter at a construction site and was struck in the head by a falling wood beam. Our client was taken to the emergency room and complained of head, neck, and back pain associated with amnesia as to the events of the accident. The client began treating their neck and back and received cognitive therapy. Eventually, they underwent spinal surgery, preventing them from returning to work, and asserted a claim for future lost earnings.
The defendants claimed that our client’s injuries and complaints concerning his neck and back were degenerative in nature, unrelated to the accident, and his symptoms were not consistent with his injuries. Defendants claimed further that the client made an excellent recovery and could work with little restrictions.
