Plaintiff, a 32-year-old female, was a passenger in a motor vehicle traveling Southbound on southbound on Nagel Avenue in the right travel lane approaching the intersection of West 204th Street, New York, NY when the operator of a construction vehicle suddenly turned left onto West 204th Street and struck the vehicle plaintiff was traveling in, causing a collision.
Following the accident, plaintiff went to the emergency room via private transportation and complained of neck and back pain. Thereafter, the plaintiff began a course of physical therapy and conservative care. Plaintiff eventually underwent surgery to her neck and back.
Defendants disputed the cause of the collision between the two vehicles and claimed the vehicle plaintiff was traveling in was speeding and failing to yield the right of way. They claimed the plaintiff’s injuries were not caused by the collision and were, in fact, degenerative in nature. They also claimed the plaintiff made a complete recovery and did not require any additional treatment.
