Plaintiff, a cable installer, was installing internet service at a commercial building when a light fixture fell on his head. He was previously working in the vicinity of the ceiling where the fixture was resting on the tile ceiling grid. As a result of the accident, the plaintiff suffered an injury to his neck, which required a surgical fusion, as well as injuries to his shoulder.
The defective ceiling grid was concealed, and the defendants were aware of the subject defect. Despite the difficulty of proving a hidden defect, Jonathan Damashek was able to secure a settlement of $1,395,000.00.
