$1,300,000 – Motor Vehicle Accident – Plaintiff Driver – Hit in the Rear – Lumbar Spine Injury, Shoulder Injury

Plaintiff, a 34-year-old male security guard was operating his motor vehicle when he was struck in the rear by the defendants’ vehicle. As a result of the accident, plaintiff sustained injuries to his left shoulder and back. Plaintiff underwent arthroscopic surgery to his left shoulder and eventually underwent a percuanteous discectomy to his lumbar spine. Plaintiff moved for partial judgment on liability and the motion was granted. Defendants claimed that plaintiff’s injuries to his shoulder and neck were pre-existing, degenerative in nature, and unrelated to his motor vehicle accident. Judd F. Kleeger settled this matter at a mediation conference prior to trial for $1,350,000.
