$1,152,235 – Negligence and Medical Malpractice– Patient Falls in Hospital

Plaintiff, a 42-year-old woman, presented to Wyckoff Heights Medical Center with severe lower abdominal pain, nausea and missed a menstrual period. The hospital performed a test and determined that the plaintiff was pregnant and suspected the plaintiff of having an ectopic pregnancy (which is a pregnancy that forms outside the uterus). Plaintiff underwent a sonogram which revealed dangerous internal bleeding.

Rather than provide a wheelchair or stretcher for the plaintiff to move around the hospital, the plaintiff was directed to walk and while she was walking, the plaintiff became dizzy and fainted causing severe injuries. Plaintiff suffered a tear of the common extensor tendon requiring an open surgical repair as well as a herniated disc at C5-6 requiring cervical spine surgery.

Plaintiff sued Wyckoff Heights Medical Center alleging both negligence and medical malpractice. The case was tried by HKD, partner, Jordan Hecht and the jury found the hospital committed medical malpractice and awarded $1,152,235 in compensation to the plaintiff.
