$1,150,000.00 – Premises – Trip and Fall On Stairs – Cracked Step and Missing Handrail – Knee Injury Requiring Surgery

Plaintiff was caused to trip and fall on the main lobby stairway at the entrance to the building due to a broken and cracked step. In addition, the stairway did not have a handrail on either side in violation of the building code. Plaintiff injured both knees, right greater than left. Plaintiff underwent arthroscopic surgery to her right knee 8 months after the accident for a torn meniscus. Subsequently, plaintiff began to experience increased pain and mechanical symptoms to her left knee, and eventually underwent arthroscopic surgery to her left knee in October 2006. Thereafter, plaintiff continued to experience chronic pain and limitations to her left knee and underwent 2 more arthroscopic surgeries. Defendant claimed plaintiff was partially responsible for the happening of the accident and made a complete and full recovery with absolutely no disability. Judd Kleeger settled this case at jury selection for $1,150,000.
