$1,140,000 – Workplace Accident – Back and Knee Injuries

Plaintiff, a 37-year-old police dispatcher for the City of Yonkers was injured while she tripped and fell on the way to use the restroom at work. At the time of the accident, plaintiff’s foot was caught on a small piece of fraying carpet, causing her to trip and fall to the ground. HKD filed suit against the owner of the building who HKD claims should have known about the defective carpet and repaired it prior to the accident. HKD also filed suit against the cleaning company who plaintiff alleged made the condition worse through the use of a vacuum in the area of the fraying carpet. Defendant denied that there was a defect and also argued that if there were not given notice of the defect prior to the accident. As a result of the accident, plaintiff suffered injuries to her lower back and knee which required surgical intervention. HKD partner, Jonathan Damashek settled this matter at a mediation prior to trial for $1,140,000.
