Plaintiff, an 18 year old female, was a passenger in a motor vehicle traveling southbound on Second Avenue in the far right travel lane approaching the intersection of East 102nd Street, New York, NY when the operator suddenly turned left across all lanes of traffic on Second Avenue in an effort to make a left-hand turn onto East 102nd Street, when their vehicle was struck by an ambulance traveling southbound on Second Avenue in the left travel lane.
Following the accident plaintiff was taken to the emergency room via ambulance and make complaints of neck and shoulder pain, and began a course of physical therapy and conservative care. Plaintiff eventually underwent surgery to her neck and shoulder. Plaintiff was working as a cashier and did not return to work following the accident.
Defendants disputed the cause of the collision between the two vehicles. Defendants claimed plaintiff’s injuries were not caused by the collision and were in fact degenerative in nature. Defendants also claimed plaintiff made a complete recovery and was able to return to work without any restrictions or limitations.
