Plaintiff entered a building to pick up her child at a day care center when the armature from a magnetic door lock system fell and struck her on her head. As a result of the accident, plaintiff sustained a herniated disc in her cervical spine. Following a course of conservative care and pain management, plaintiff underwent cervical spine surgery.

Plaintiff claimed the defendants failed to maintain their premises in a reasonably safe condition and caused and created the condition following a repair.

Defendants claimed they did not have any notice of the defective condition and did not cause a create the hazardous condition as the result of work done to the locking system ten days prior to the accident. In addition, defendants claimed that plaintiff’s injuries were not caused by the accident and her herniated discs here degenerative in nature.

Judd F. Kleeger, Partner, settled this matter prior to trial for $2,225,000.
