Plaintiff, 45 years old female, was a passenger in a vehicle that was struck by another vehicle owned and operated by the City of New York. More specifically, the vehicle owned by the City of New York collided with the vehicle plaintiff was traveling in while merging and/or attempting make an illegal left turn at the intersection of Creston Avenue and Burnside Avenue, Bronx, New York. Plaintiff sustained neck, back and a right shoulder injuries. Following a course of conservative care and physical therapy, plaintiff eventually underwent cervical and lumbar spine surgeries. Plaintiff returned to her full-time job and did not have a claim for lost wages.
Defendants claimed that the property damage to plaintiff’s vehicle was minimal. Defendant also claimed plaintiff injuries were degenerative in nature, her complaints were related to pre-existing conditions, and she did not need any future care or treatment. In addition, defendants claimed that plaintiff’s surgery was unrelated to the motor vehicle collision.
