Plaintiff, a 36, union drill runner, was working on the construction of the World Trade Center Transit Hub when he was caused to trip and fall off the side of an unguarded elevated work platform. Plaintiff alleged that the defendants failed to provide proper protection in the form of railings and failed to remove tripping hazards. As a result of the accident plaintiff sustained injuries to his neck and back that required surgery. The case settled for $4,850,000.00 just before the start of the damages trial.
