$1,800,000 – Work Place Accident – Falling Shelf – Back and Shoulder Injuries

Plaintiff, a custodial cleaner, was working in an office when a shelf fell from the wall, struck the plaintiff and knocked her to the ground. Plaintiff reported the accident but did notice any injuries initially. Over the next few days, plaintiff began to experience pain in her lower back running down her legs as well as right shoulder pain Plaintiff was diagnosed with herniated discs at L4-5 and L5-S1 and ultimately had a lumbar fusion.

Plaintiff also suffered a torn tendon in her shoulder that required arthroscopic surgery. Defendants argued that the shelf never struck the plaintiff and all of the plaintiff’s injuries were pre-existing. The case was settled by HKD partner Judd Kleeger.
