Plaintiff, 29 year old female, was a pedestrian crossing the street within the crosswalk when she was struck by the defendant’s vehicle making a left turn. Defendant claimed the injured pedestrian failed to cross within the crosswalk, defendant completed his left turn and was driving straight along the roadway, and plaintiff walked into the side of his vehicle. Lastly, defendant claimed that plaintiff stated at the scene that the car only rolled over her foot.
Plaintiff complained of neck and back pain and presented at a medical clinic for treatment on the date of the incident. Plaintiff underwent a course of conservative care, including physical therapy, acupuncture, chiropractic and electrical stimulation. Plaintiff eventually underwent cervical spine surgery.
Defendant claimed plaintiff’s injuries were degenerative and unrelated to the motor vehicle accident since the tire of the car only ran over her foot.
Judd F. Kleeger, Partner, settled this matter prior to trial for $1,125,000 as there was limited insurance coverage.
