Construction Accident – Fall from Ladder – Head and Neck Injuries – $3,350,000

Plaintiff, a construction laborer, was working atop and A-frame ladder when the ladder shifted causing plaintiff to fall from an elevated height. Plaintiff was briefly rendered unconscious and was taken by EMS to the hospital where he was diagnosed with a neck injury and traumatic brain injury. Plaintiff commenced an action alleging violations of NYS Labor Law that requires ladders to be secured. Defendants argued that plaintiff did not fall from a ladder rather he tripped and fell walking down steps. As a result of the accident, plaintiff underwent spinal fusion surgery in his neck and was unable to return to work. The case was resolved by HKD partners Jordan Hecht and Jonathan Damashek before trial.
