Plaintiff, an undocumented laborer was working atop a 15 foot scaffold when the platform shifted causing him to fall to the ground below. Plaintiff sustained fractures of both ankles requiring placement of metal rods and screws as well as a fractured lumbar vertebrae. Plaintiff commenced an action against the owner of the property claiming that he was not provided with adequate safety devices. Plaintiff obtained summary judgment pursuant to Labor Law § 240 and the case proceeded to trial on the issue of damages. The case was settled before jury selection for $4,000,000.00 by HKD partner, Jordan Hecht.
