Plaintiff, a 35 year old librarian, was walking in the parking lot of a shopping center, when she was caused to slip and fall on a large patch of ice. Plaintiff testified that the parking lot owners repeatedly failed to properly remove snow and ice from the lot and she had complained to her supervisor about the condition. Defendants argued that the lot was properly maintained by a snow removal contractor and the lot had recently been plowed and salted. Defendants further argued that plaintiff was at fault for not paying attention and caused her own accident. As a result of the fall plaintiff sustained several fractured vertebrae that required spinal fusion surgery. Plaintiff missed approximately 1 year from work and then returned on light duty. The case was tried by Hecht, Kleeger & Damashek, P.C., partner Jordan Hecht. The jury reached a verdict finding the shopping center owner 100% at fault for causing the accident and plaintiff was awarded $2,000,000.00.
