Plaintiff, a 24 year old demolition worker was removing a large window from a wall when a large piece of metal fell from a height striking the plaintiff and knocking him to the ground. Plaintiff claimed the building owner did not provide proper safety devices under Labor Law § 240. The building owner argued they were not required to provide safety devices for the work plaintiff was performing. Plaintiff sustained a torn rotator cuff that required arthroscopic surgery as well as a herniated disc in his cervical spine requiring a one-level cervical fusion. The case was settled at mediation for $1,900,000.00 by HKD associate Jeffrey Koenig and HKD partner Jordan Hecht.
