$1,250,000 – Motor Vehicle – Livery Cab Driver – Neck and Back

Plaintiff, a 63 year old livery cab driver, was injured in a car accident when the defendant ran a red light. Defendant argued that he was faced with an emergency situation as a result of sun glare and thus was not liable. Hecht, Kleeger & Damashek argued the defendant was at fault and the court determined the defendant was 100% liable for the accident. Plaintiff sustained herniated discs in his neck and back and ultimately underwent a cervical fusion surgery. Defendants argued the diagnostic films show age related changes and thus the injuries were pre-existing. The case was resolved by HKD partner Jordan Hecht for $1,250,000.00.
