When you or a loved one has been injured it’s often difficult to figure out what is he next step to take. You may be thinking to yourself ‘can I file a personal injury lawsuit?’. This blog post will cover some of the steps needed before you file a lawsuit.shutterstock_173305826

In order to receive monetary compensation, you must first prove three things:

  1. The responsible party was negligent. For example, if a building owner mopped the floor but didn’t put out a sign indicating that the floor was wet and someone slips and falls causing them to become injured, the building owner was negligent.
  2. The negligence caused the injury. In the above example, if the victim’s fall caused them to have neck or back injuries then the negligence would be considered to have caused the personal injury.
  3. The injury resulted in harm. If the aforementioned victim received medical bills, lost wages, and/or pain or suffering due to the injury that injury would be considered to have resulted in compensatory damages.

With that in mind, it is paramount that a potential personal injury victim sees a medical professional right away to document the injury.

Another aspect that may help you realize if you have a valid personal injury claim is common sense. Could this injury have been prevented if the negligent party was more careful?
