April Showers Bring Slip and Fall Accidents

Slip and Fall AccidentsSpring is almost upon us and with it come the spring showers. Unfortunately, with those showers come slippery surfaces that can cause people to slip and fall. Sometimes a slip and fall accident isn’t just clumsiness but actually is a product of neglectful caretaking. Thousands of people around the country are injured each year, some of the seriously, by slipping and falling on slick floors, stairs, or any other surface. However, it can be difficult to prove that the owner of the building or property is at fault.

Property owners have to take reasonable measures to ensure that their property is free from dangerous conditions that would cause a person to injure themselves. However, if you or a loved one have slipped and fallen on someone else’s property you will have to prove one of the following in order to win a case:

 

  • Either the property owner or his employee should have known of the dangerous condition because another, “reasonable” person in his or her position would have known about the dangerous condition and fixed it.

 

  • Either the property owner or his employee actually did know about the dangerous condition but did not repair or fix it.

 

  • Either the property owner or his employee caused the dangerous condition.
