Plaintiff, a passenger, was involved in a two-car motor vehicle accident. Plaintiff suffered a fractured humerus requiring an open reduction with the placement of metal hardware and a nerve injury. Plaintiff was not wearing her seatbelt at the time of the accident. Plaintiff commenced an action against the driver and owner of each vehicle for negligence and pain and suffering.
