Plaintiff, a 41-year-old truck driver, was injured when his boom-truck was struck by a speeding car. Plaintiff sustained injuries to his lower back and right shoulder. Plaintiff underwent a lumbar spinal fusion surgery and right shoulder arthroscopic surgery. Defendants argued that plaintiff caused the accident by failing to yield to oncoming traffic.
